DUI Punishments

First Misdemeanor DUI

a. City Charge: 0-6 Months in Jail
b. County Charge: 10 Days to One Year in County Jail and up to $1000.00 fine.

First Felony DUI

One to Five Years in Prison and up to $2500.00 fine.

Second Felony DUI

One to Seven Years in Prison and up to $5000.00 fine.

Third Felony DUI

One to Ten Years in Prison and up to $5000.00 fine.

In addition to the punishments listed above, all individuals are required to get an alcohol assessment and follow the recommendations therein.

DWI is a misdemeanor and carries up to 6 months in jail and up to a $1000 fine.

Negligent Homicide: 0-1 year and or a fine from $100-$1000.

Manslaughter: Four years to life in prison and up to a $10,000 fine.
